Jamal Greene Biography

Jamal Greene is a constitutional law scholar in the United States and serves as the Dwight Professor of Law at Columbia Law School. Greene teaches constitutional law, comparative constitutional law, the law of the political process, the First Amendment, and federal courts. His scholarship focuses on the structure of constitutional arguments, critiquing the U.S. legal tradition's approach of treating constitutional rights as absolute and advocating for a proportionality-based method that weighs rights against broader policy considerations.

Before entering the legal field, Greene worked as a baseball reporter for Sports Illustrated. He holds an A.B. from Harvard College and a J.D. from Yale Law School. Greene completed clerkships for Judge Guido Calabresi on the U.S. Court of Appeals for the Second Circuit and Justice John Paul Stevens on the U.S. Supreme Court. Prior to joining Columbia Law School, he was the Alexander Fellow at New York University School of Law.

Greene is the author of the book "How Rights Went Wrong: Why Our Obsession with Rights Is Tearing America Apart," which examines the reconciliation of rights through legislation and compromise rather than judicial absolutism. The book draws on historical analysis of the Bill of Rights and comparative constitutional practices to argue that rigid rights adjudication can increase polarization. Greene's articles, published in journals such as Harvard Law Review and Columbia Law Review, address topics including rights as trumps, rule originalism, and the anticanon of reviled precedents, contributing to debates on judicial methodology and federal courts. He has received honors including the Burton H. Brody Prize for best paper on constitutional privacy, the Smith-Doheny Legal Ethics Writing Prize, and the Edgar M. Cullen Prize for best paper by a first-year law student.

Greene has contributed to public discourse as one of four inaugural co-chairs of the Oversight Board, which adjudicates Facebook's content moderation decisions. He served as senior visiting scholar at the Knight First Amendment Institute at Columbia University, commissioning and overseeing research on free speech and new communications platforms. Greene also served as an aide to Sen. Kamala Harris during the Senate confirmation hearings of Justice Brett Kavanaugh. He is a member of the American Law Institute and sits on the Board of Academic Advisors of the American Constitution Society.

Greene is a media commentator on the Supreme Court and constitutional law, with articles appearing in The New York Times, Slate, New York Daily News, and The Los Angeles Times. He has been a visiting professor at Harvard Law School and has served as Columbia Law School's vice dean for intellectual life.
